Juror Availability Questionnaire

  • The court may excuse you from jury service if it concludes you would suffer undue hardship. The court understands that jury service may be an inconvenience for many and often takes us away from other important matters in our personal lives. However, if jurors are excused for inconvenience, there would rarely be any citizens available to serve and we would be unable to fulfill our obligations under the Constitution. Please review the following carefully to assess whether you wish to be considered for an undue hardship excusal.


    The law defines undue hardships as follows:

    1. The juror has no reasonably available means of private or public transportation to court.
    2. The juror has a planned medical procedure or surgery during the time of the trial.
    3. The juror has pre-planned, pre-paid vacation during the time of the trial.
    4. The juror must travel an excessive distance to court, ie, 90 minutes or longer each way.
    5. The juror will suffer extreme financial hardship. This means that the juror is not paid for jury service, or is paid for only a limited number of days, and by sitting on the jury for the length of time the trial is estimated to last, the juror will be substantially compromised in their ability to maintain financial stability for themselves and/or their family.
    6. The juror will bear an undue risk of injury or destruction of property, and it is not feasible to make alternative arrangements to alleviate the risk.
    7. The juror has a physical or mental disability or impairment that would expose the juror to an undue risk of physical or mental harm.
    8. The juror’s services are immediately needed for the protection of public health or safety, and it is not feasible to make alternative arrangements.
    9. The juror has a personal obligation to provide necessary care to another, including sick, aged, or infirm dependents, or a child who requires the juror’s personal care, and there is no comparable substitute available that would not cause undue economic burden on the juror.


    The following are NOT legal hardships:

    1. The needs of your employer.
    2. Travel plans or critical appointments that can easily be changed.
      • However, the court may consider a deferment in such a situation.
    3. Full-time students
      • However, the court may consider a deferment if a student will miss a significant amount of instruction such that it would impair that student's ability to successfully complete their coursework.

Please note that if you decline to provide information about your vaccination status, we will assume you are unvaccinated for purposes of any rules or requirements in the workplace that are different for vaccinated or unvaccinated individuals.

    For purposes of this self-attestation, you are considered “fully vaccinated” two weeks after completing the second dose of a two-dose COVID-19 vaccine (e.g., Pfizer or Moderna) or two weeks after receiving a single dose of a one-dose vaccine (e.g., Johnson & Johnson/Janssen).
